I need feedback from you guys. I have researched this lawyer before I got her to start my greencard and the feedbacks seems that she is efficient and knowledgeable. However, since we signed the contract with her, things have been moving so slow. She doesn't want to talk to me or give me status updates when asked. She has all the information needed from me and my employer to start the prevailing wage request but a month has passes and nothing has been requested yet. Has anybody here experience the same thing?

My friends received Green cards in 2007. They live abroad, but make regular trips tho the Us to visit family and maintain their GC.
Unfortunaltely, they recently misplaced their green cards. They are planning a trip to the US this month, for which they have received travel letters from the US Embassy abroad.
Would anyone know what the process is afterwords? We know they have to file I-90s to replace their lost GC. Does this have to be done at the port of entry? Or is it done at a local office on reaching their final US destination?
Also, will they be called for a biometric appointment locally or can that be done at a Port of Entry. Can the biometric be done at a location abroad?
If anyone has any info on this, it'd be truly appreciated.

Hi,
I lost my original passport and was issued a new passort which is valid till 12 feb 2007. I mailed my application to the indian consulate but they stamped the extension of passport for 1 more year. The first page of the passport say it expires the on 12th feb but on the next page th consular general stamped the extension of the passport till 12th jan 2008. I am goin to india on 26th jan for H1b stamping. I wanted to know what are the chances of the visa getting rejected at the US embassy. Alsp is the passport valid for travel

You can keep extending the H1-B till your Green card is approved.

I joined and contributed already to the IV although I am not yet on the GC queue. I support you all with my heart.
I have a different concern about PERM filing. My application will be EB2 with Ms + 4 years as Senior Soft Eng, and my lawyer asked my manager to create the business necessity letter for MS degree. He is not experienced with this kind of paperwork and the lawyer seems to be just not helpful rather demanding... I was wondering if somebody in IV had to deal with this business necessity letter. Any information would be helpful...

My I-140 & I-485 applications had been transferred to VSC for receipting and later my I-485 was transferred back to TSC. But my I-40 has been pending at VSC for close to 6 months with no signs of any processing. VSC seems to be still processing Apr 06 applications while TSC has been processing I-140 under 6 months. Realistically my application should have stayed at TSC, but was transferred to VSC due to receipting delays and balance the workload. But now my application is stuck at VSC. For no fault of mine, my applications ended up in VSC. There is no signs of PP starting anytime soon. Can I lodge a complain to ombudsman in this regard? Will they be able to help me? Who do I contact and where can I find all the information to lodge a complaint?

Rediculous, the processing times say it takes 90 days minimum. Hopefully they will give the extension from my expiry date which is Aug 28th 2008.
As USCIS is saying they will issue 2 year ead starting Jun 30. certainly I will not get a 2 year EAD.

It is shifted to P-BEC. I have not got any 45 day letter for that

Is it possible to upgrade a pending I-485 (EB3 I-140) with a newly approved EB2 I-140?
Is there any USCIS mandated procedure to do that?
I think it will be taken care automatically, ( since your A number on I 485 and new I 140 will be the same )

Could anyone share their experience/knowledge about getting home loan on EAD? My bank says that, for non-FHA loans, you need to be in any of the visa categories like H1, TN1, GC, ... But its list doesn't include EAD or Adjustment of Status. Can that list be challenged to include EAD? That is, how to convince the bank/lending inst that EAD is a legal/legitimate status like H1?

You need to have an 1-485 application in at least for six months before using portability.
You can contact a body shopper and ask them to file I-140 and use your current priority date.
There is nothing else possible if you are already at your sixth year of H1B.

Valid AP is enough to travel - no one should care about your EAD if you are entering based on your AP. Ofcourse, always carry a copy of the I-485 and your wife can say that you are the primary applicant if they ask for her work status, etc...
