    I was just wondering why legal immigration is not generating any interest with the beloved politicians in this country. Inside the mind of these politicians... I guess their agenda is very clear.

    Immigration support for illegals = hispanic votes = reelection!
    Immigration support for widows = sympathy votes = reelection!
    Immigration support for same sex partners = more votes = reelection!
    Immigration support for serving the military = Show of patriotism = society respect!
    ...
    ...

    But,
    Immigration support for legal immigrants = what's the use = not a penny worth!!!

    Oh God help us!

    I have an H1B approval from USCIS, and I am trying to go to Canada for the initial visa stamping. But then i have a problem. I initially entered the country as a visitor, and married a citizen, but only after my I-94 had expired for about a week. (My petition is still pending. The company I am working for could not wait for my greencard, since its already been years since I started that process, so they went ahead and applied for the H1B visa for me). I heard that it is a problem to do the visa stamping in Canada if you have been out of status before. Is it advisable to go to Canada for the visa stamping?:confused:

    I-140 PP filed on June 22nd, received by USCIS on June 26th (date updated on CIS website) and approved on June 29th.

    My wife was on f1 status when we filed for 485.
    We went to india this last december and used AP, no issues what so ever.

    Make sure you do provide the old 94 to airlines before leaving US.

    Hello,

    These are my details :

    I-140 -> Jul 07
    I -485 -> Aug 07

    I -140 Denied in may 08. There was no appeal no MTR
    I-485 shows pending

    New I 140 was filed in Jun 08, we got receipt information.

    On that A# is same as the A# issued for I-485

    Questions:

    a) Is my I-485 still valid?
    b) Is it tied to new I-140 we filed?
    c) Can I renew my EAD and AP if I 485 is valid?
    d) How to check all the 3 above?

    1. I got laid off from company A last year. I was on H1B. Company A notified me about 1 month in advance so I had some time to find another job. I also had a valid EAD which I wasn't using at that time. They also did not cancel I-140.
    2. I joined Company B using my EAD within the 30 day period, so I never went out of status. Also, I didn't file AC21
    3. My GC application was approved in the first week of Aug.

    I have a couple of really interesting opportunities that I would like to pursue. My job profile has been similar at both A and B and will likely be similar even in C should I join there. Am I required to work at B for any specific period of time before I can pursue these opportunities?

    My Title is different in H1-B and GC, though it is in the same field.. I am going for stamping to Chennai in January.. Will this be a problem ? Will they ask questions about I-485 filing in H1-B stamping ?

    Can i cancel appoinment one day before.
    I saw in www.vfs-usa.co.in website ,have to cancel before two working days of appointment day.
    If i cancel appointmentafter few days will i have to fill again DS156,157 forms for appointment.
    In website they said cant cancel appointment 2 times.After 2 times cancelation have to wait 90 days with that hdfc barcode.
    Before 90 days period can we fix new appoinment by paying agian into HDFC bank.Is this possible new appointment with new barcode.

    Is my birth certificate needed to invite my parents on visitor visa? Isn't my SSC certificate showing date of birth and both parents name enough?

    Birth certifcate is a good document to prove the genuineness of the ties with people you claim to be your parents and whom you are trying to get here.

    Its good to show it if you have it. If you are afraid of sending the Original send a US notarised copy.

    The intention of the document is to only prove your ties with your parents.

    If you do not have one or do not wish to furnish one, you can still try.

    My company is filing 140 and 485 on a preapproved LC (PD of 2005)

    But my original LC in P-BEC just got cleared (PD of 2003). They told that they will also use my original LC for 140 as this gives better chance than the substituted one.

    1)How Can I have 2 140's ?

    3)How will it effect 485?

    I'm confused ..please answer

    Hi Guys,
    My wife is going to go to school this August for her masters. I am on H1 she is here on H4 and My I 140 is cleared. Now my question is
    1> Is it possible for her to convert to F1 (she is still not part of the GC process we haven't filed I 485)?
    2> What is the process to get this conversion of status done?
    3> How long does it take? (we live in California and she will be going to school in CA as well.)
    4> I understand that for her to get OPT she should be on F1 but does it matter for how long she has to be on F1?
    5> Just change of status is enough of would she need to get F1 Stamped?

    Kudos to my colleague Elissa Taub who pointed out something rather interesting that none of the supporters of the Arizona law have told Arizonans. Under federal immigration law, a removal proceeding is a civil proceeding and one is not entitled to a public defender or any assistance in paying for help from an immigration lawyer. However, the new Arizona law makes it a state crime to be illegally present in the state. What this means is that any person charged under the new law is entitled to a taxpayer funded public defender or taxpayer funded private lawyer. And we lawyers...

    I am sure that IV core team organizes events and actions pretty well. I know there are usually action items that get posted on IV.

    How about thinking about the action items in a different perspective. For any event/action, create a task force. Ofcourse that may have been what is done as of now. But all am saying is create a taskforce every action/event to be organized at different levels vi.z, IV Core, IV State, IV Local and create a menu item called TaskForce on the main page. Anyone who is interested in a particular event or action would get in touch with the taskforce team.

    Not sure if it makes sense but just a thought of coining a different name for the action items with assigned roles and ability to contact easily.
