USCIS kept on updating the total number of cases received for H-1B for FY 2009-10. However, the recent USCIS H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap count indicates decline in number of cases than what had been previously reported. The updated count reports the receipt of 44,400 �Regular� cap cases, by June 12, 2009 which is lesser than the prior count of 47,700, given as of May 22, 2009. There is no explanation too from USCIS for this decline in trend. Thus, this reduced number may reflect either withdrawals by employers, denials by the USCIS, duplicate filings, or an error in the prior cap counts.
As of this writing, both the Advanced Degree and Regular caps remain open. We will continue to provide updated H-1B cap count information.

My manager got an email from USCIS saying my I140 is approved and they will mail the approval notice. Online case status show that approval notice emailed. But we haven't received any emails about the approval notice. Do USCIS sent paper approval notices??

Hello ,
I recently changed my visa status from H4 to F1. I received my I-797 yestreday, and noticed that the I-94 attached with the I-797 has my birthdate printed wrong on it. I confirmed with my school, and they told me that there was a mistake in the I-539 application for change of status that I had filed, the birthdate was written wrong there. I also visited the local USCIS office and they told me they do not correct these errors and I need to send an application to the service center (california service center).
Please can anybody advice me as to what form do I have to fill, and how much time will this process take. I have got an oncampus job, in this case can I apply for a SSN with the I-797 with my birthdate mentioned wrong on I-94, my passport and my I-20 has the birthdate right. Also will there be any problem while my application to correct I94 is in process when I apply for my OPT since this is my Final semister in school
Please advice me I am really worried....

In the early 1960s, President Eisenhower worked with the Catholic Church to airlift 14,000+ unaccompanied minors from Cuba to America in an effort called Operation Pedro Pan. In a similar effort, President Obama is working with the Catholic Church to possibly airlift thousands of orphans from Haiti and allow them to remain in the US in a humanitarian parole status. Obviously, this will be a huge challenge and it is always a difficult decision to remove children from their homeland, but the future for orphans in Haiti seems very grim.

On October 20, the Executive Office for Immigration Review (EOIR) rolled out its new website. Can someone advise on the alternatives of marriage / DOB certificates for the I-485 phase? My wife and I don't have a marriage certificate--we do have an affidavit from India, though (we married 10 years ago in India). Likewise, we don't have our DOB certificates issued by the municipalities we were born in. Would school certificates/affidavits from our parents work? What would be the easiest / quickest substitutes?

Just wanted to get some feedback whether its possible to get i-140 approved using an old approved labor ?
- Case:EB3 ROW.
- The company A merged with B. (may be a successor-in-interst)
- Labor from B approved in 2005 w/pd=2005
- Labor from A approved in 2006 w/pd=2002.
- I-140 using 2005 LB approved with B
- Lawyer suggests to use the A's 2002 Labor to file a new i-140 under company B. He says that as per some law the old labor is still valid until end of this year. Please advice.

Public satisfaction with the job lawmakers are doing has fallen 11 points since May, to 24 percent, according to an Associated Press-Ipsos poll. That's lower than for President Bush, who hasn't fared well lately, either.
Bush has been taking heat over the Iraq war, his decision to spare a former top vice presidential aide from going to prison and his desire for an overhaul of immigration laws that critics said would give a free pass to illegal immigrants. His job approval rating in the AP-Ipsos survey remained virtually unchanged at 33 percent.
The 24 percent approval rating for Congress matched its previous low, which came in June 2006, five months before Democrats won control of the House and Senate due to public discontent with the job Republicans were doing.
Just two months ago, 35 percent of the public approved of Congress' work.
Poll respondents from both political parties say they're tired of the fighting between Congress and the White House, and want the two branches of government to work together on such issues as education, health care and the Iraq war.
"They don't approve of anything he does," Theresa Holsten, 55, a Republican and unemployed resident of Lawton, Okla., said of Congress. "He can't do anything right, according to what some people say. It irritates the living daylights out of me."
Tammy Lambirth, 42, a data researcher from San Antonio, disapproves of "all the fighting that they do all the time."
The latest tussle involves Bush's refusal to hand over documents and let former White House aides answer questions from the Democratic-controlled Congress about the firing of U.S. attorneys. The dispute could end up in federal court.
"The Republicans are just stonewalling everything, and the Democrats are just not stepping up and making them do what they need to do, especially about Iraq," said Lambirth, a Democrat. "They need to make our troops get out of Iraq."
While the public's approval of Congress has dropped 11 points since May, the percentage of Democrats who are turning up their noses at Congress - like Lambirth - nearly doubled. Among Republicans, though, not so much.
Approval among Democrats fell 21 points, from 48 percent in May to 27 percent.
It remained low among Republicans, at 20 percent, and has not changed significantly in the past two months.
Democrats won control of Congress on the strength of their promises to end the Iraq war, but so far have failed to do it. Bush vetoed one spending bill that included a deadline for ending the war, and Democrats don't have the votes to override him.
An increase in the federal minimum wage became law, but much of the Democratic agenda has cleared the House only to become bottled up in the Senate, where the party has a much narrower working majority.
Democrats need to be mindful of the public's satisfaction with Congress' productivity, especially as the party campaigns to win back the White House in elections next year, said political science professor Kenneth Sherrill.
"If you manage to persuade a very large number of voters, including an increasing percentage of people who associate with your own party that you're not capable of governing, you're in real trouble," said Sherrill, who teaches at Hunter College in New York City. "That is not a good message to send."
Among other survey findings:
Bush's marks on his handling of the economy and domestic issues like health care, education and the environment, held steady, at 37 percent on the economy and 33 percent on domestic matters. Last month, Bush was at 37 percent approval for his stewardship of the economy, and 32 percent on domestic issues.
On handling of foreign policy, including terrorism, 38 percent approved, compared with 35 percent last month.
On handling the Iraq war, 31 percent approved, compared with 28 percent last month.
One-fourth of the people, or 26 percent, said the country is headed in the right direction. Last month, 21 percent said the country was on the right track.
The telephone survey of 1,004 adults was conducted July 9-11 in English and Spanish by Ipsos, an international public opinion research company. The margin of sampling error was plus or minus 3 percentage points.

Folks, This thread is to track the I 485 approvals. Please mention your PD and RD for I 485 here. Mine is with a priority date of 4/3/2002 and RD of 12/29/2004. Still waiting while many others with a later PD have already got their GCs recently.

My wife's finger printing fee was rejected last month even though we sent the correct fee. We sent the fee again.
But in the mean while, we also recieved our finger printing notices. Does anyone know as when we would get our EADs ?

off the Topic! Sorry. Wondering if any IVian has good idea about itemized deductions we can take while working on 1099-MISC instead of on W-2? I am panning to file I 485 before July 31st. Also I am planning to go on vacation to India around Aug 10th. The trip to India is unavoidable.
Experts please answer the following question:
1) Both me and my wife are on H1 and it has to be stamped. Will I 485 Filing have any adverse impact on the H1 Stamping ?
2) Will leaving the country for vacation without the I 485 receipt have any impact on the I 485 process.
