    Hi

    Would really appreciate if some one can answer this question.

    Is it possible to movie from H1B to EDA (valid unitl Oct 2010), work part time on EAD to complete Master's degree and then move back to the same employer to continuing working full time on H1B?
    (assuming current employer is willing to allow going part time)

    My parents will be visiting us here soon, and when they return, we want to see if we can send kids to India (2 and 5yrs). Kids have never been to India, and I would like to know which is a better option and why. Greatly appreciate your advice.

    You can get I-20 etc. But I think you will have to go to home country to get your F1 stamped. But better check with a lawyer.

    Hi,

    I wanted to now how you guys are going about AP and I94 renewals.

    If we use AP to come to US, then our I-94 is valid only for 1 year i.e till AP expires.. So, if we apply for AP renewal, what will happen to I-94? Do we need to renew it? If yes, what is the procedure?

    And, If we have a valid H4 visa for 2 more years but started working on EAD, when we enter into US, do we need to use AP for sure or can use H4 as it is still valid? If we use H4, will our EAD become invalid?

    Please let me know.

    Hello,

    I would like to prepare for the worst scenario that might happen in near future since I only got about two months of H1B
    I didn't even know what " RFE" was until I recently received it. From my first H1B app to LC, things have gone so smoothly.. but now I am starting to realize that this could be jeopardize my whole career in U.S if I don't get approved from I140.
    When I started my PERM processing last year,my lawyer made sound so easy about getting a GC that the paralegal who handles my case has never told me anything about" if things goes wrong",which I am afraid that it might be happen soon...


    If I get denied from I140, Is there a way to extend my H1B ? or any other way to keep my job in U.S legally ? Could anyone give me some advice ?

    Apr 2009 Priority Date EB2

    May 2010 I140 EB2 filed
    May 2010 I1485 filed
    July 2010 I140 RFE

    H1B 6th year (exp. OCT1 2010)

    I signed an employment agreement stating that if I had to leave my employer before getting my Green Card that I will be liable for all the fees pertaining to the Green Card application which my employer has been paying for while I am been employed by him.

    I have heard that an employer cannot hold Green Card fees over an employee. I also believe if anything, the fees owing should drop according to the length of time that the employee has worked for that employer.

    I have been with my current employer for 4 years now and I wish to leave him but I do not want to pay him for the Green Card fees as I believe that should be a business expense to him.

    I would just like to know what are my rights in the above case

    While taking a VISA appointment , there is a question which says "Are you applying for same visa class that expired in the last 12 months?"

    Here are my doubts

    1. I had a H1 B VISA which expired in May 2007 processed by my previous employer. As I am applying for the same VISA class , but though a differnt employer, should the answer be 'YES'?

    2. Since my daughter will be appearing for the H4 VISA interview for the FIRST TIME, Is she also eligible to come along with me if I choose "YES" to the question "Are you applying for same visa class that expired in the last 12 months?".

    I got my EAD last October (filed for my I-485 on July 02, '07) but did not apply for my AP then;

    Now I need to apply for my EAD renewal and am also thinking of getting an AP. Do I need to get an AP for the current year (that is for the time period from Oct '07 to Oc 08) and then apply for AP extension or can I directly apply for AP for Oct '08 to Oct '09?

    the second option will save me money and so for me that is the preferred one :D

    any information on this is much appreciated,

    AC21 pioneers, any recommendations on picking lawyers around NYC? specifically those that are fairly responsive and charge a fair price on all the procedures / docs that come with maintaining AOS, including a possible AC21 notification letter, renewing EAD/APs....

    Yes you can travel with H4 to US with your Wifes H1 and then transfer to H1 if its still vaild at the time of transfer.. Note you can also use your existing H1 as well, As per rule an H1 can be in the US for 6 years. if you have spent some time in between outside US that duration will not be counted in the 6 yrs. So calucate your exact number of days spent in US and if it exceds 6yrs then its not possible to use your existing H1. Note: the days spent on H4 will not be counted in 6 yrs but days spent on L1 will be counted.---

    Company A applied for labor(EB2) in Dec2006. It was approved.
    My I140 was filed in March 2007 and approved on Jan 10 2008.
    I did not file for I485 in July 2007.

    I had changed companies in April 2007.Presenly I am on Company B payroll.

    Now, If I move back to Company A, would I be able to apply for my I485 when the date opens.
    The online status for I140 says, Approved.
    I am in good terms with both the employers.

    If I move to company A; at the time of applying I485, do I need to have paystubs from Company A?

    Please help. Thanks

    I am currently working for company A under H1B visa. Company B recently bought all of Company A�s Assets. I am still working for Company A (doing clean-up work) but will be laid off shortly (within a month). Company B offered me a similar position.

    I read that since Company B bought all the assets and runs a similar business they would be considered as "successor of interest�, therefore, we would not need to file a transfer with USCIS and a simple letter would be sufficient.

    How does that work exactly? Can I travel with my old visa and the letter? What happens if later on Company A is dissolved? Cancel the visa?

    I think that Company B is ready to sponsor me for the Green Card. I�m not sure that they would be ready to pay for the fees for the transfer AND the green card now. I would really like to start the Green card process as soon as possible since it takes so long. I understand that it might be better to file a transfer to be on the safe side but if I can save some of the fees it would be great.
